Connect Job Workers Terms and Conditions

Article 1 (Definitions)

  1. ”Connect Job Workers”shall mean, collectively, the general job information service site for job transfers on the Internet provided by Fourth Valley Concierge Corporation (hereinafter referred to as ”FVC”) and the message distribution and other job change support services for users provided by FVC incidental to such site.
  2. information (as defined in the ”Privacy Policy”) and other information to Connect Job Workers through procedures designated by FVC (hereinafter referred to as ”User Registration”) and approved by FVC.
  3. ”Scout” is an optional service that enables the User to receive an offer containing job offering information, which is sent if a Recruiting Company (as stipulated in Item 4), FVC Agent or Agent (as stipulated in Items 5 and 6) (hereinafter collectively referred to as a ”Recruiting Companies”) accesses and uses information designated by us other than non-public information, such as name, reading, address, telephone number, e-mail address, date of birth, and use history (as defined in Clause 10 of this article), among resumes, job resumes and CVs including personal information registered on Connect Job Workers screen by the User (hereinafter referred to as ”CVs”) and when it is determined that the User meets job offer conditions for the Recruiting Company. If the User sets up a system to receive this Scout, the User's CVs and other information will be available to companies and other third parties who are considering participating in Connect Job Workers in the service. Scout includes the following services:
    1. Offer Reception Service
      ”Offer Reception Service” is a service whereby Recruiting Companies have access to information designated by us other than non-public information, such as name, reading, address, telephone number, e-mail address, date of birth, etc., from among the CVs and sends to User’s job information that the Recruiting Companies determine to be able to introduce to the User (such job offering information shall hereinafter be referred to as an ”Offer”). In the event that the User has received an Offer and has not responded to the Offer for a certain period of time, FVC may, at its discretion, provide the User with information on the Recruiting Companies that sent the Offer. In addition, FVC shall not assume any responsibility even if the User is identified as a specific individual by the Recruiting Companies based on the information registered by the User in the column other than the non-public information column designated by us as mentioned above.
    2. Offer Reply Service
      “Offer Reply Service” is a service that enables Users to send CVs containing information that can identify a specific individual, such as name, reading, address, telephone number, e-mail address, date of birth column, etc., to the Recruiting Companies that sent an Offer, if a User receives the Offer and wishes to apply for the job information introduced therein.
    3. E-mail Service
      “E-mail Service” is a service that allows Users to send and receive e-mails to and from Recruiting Companies that sent the Offer after responding to the received Offer on a special page for Connect Job Workers Users.
  4. ”Recruiting Company” refers to a company that has concluded a contract with FVC for the use of Scout or for the placement of human resources, and sends the company's job information to Users who have set up to receive Scout.
  5. ”FVC Agent Service” refers to various services such as checking the contents of applications received from Users against the conditions for job offers desired by the Recruiting Company, providing job postings and supplementary job information, providing job transfer consultation through telephone or interviews, supporting job change activities by the career advisor in charge (hereinafter referred to as ”FVC Agent”), doing application procedures on behalf of Users, scouting from the Recruiting Company or Agent (only if the User wishes separately), and other information services operated by FVC. FVC Agent Service can be started by configuring to receive a Scout from an Agent, and the User must agree to FVC Agent Service Terms and Conditions separately provided.
  6. ”Agent” refers to an entity or an individual that recommends an User to the Recruiting Company if the User who has received Scout notifies his/her intention to be recommended to the Company, after sending an Offer with recruiting information of the Recruiting Company to the User who has set up to receive Scout from Agents, including companies that have entered into an agreement with FVC regarding the use of Scout and head hunter individuals who belong to a job change agent.
  7. ”Service” means Connect Job Workers and all services incidental to Connect Job Workers. All and any intellectual property rights (including the rights stipulated in Articles 27 and 28 of the Copyright Law of Japan) and industrial property rights (including the right to receive industrial property rights) relating to the Service shall belong to us.
  8. ”Information Service on Individual FVC Services” is an FVC’s service to provide at its discretion the User with relevant information regarding the contents, functions, and use of individual services managed and operated by FVC (hereinafter referred to as the ”Individual Service(s)”) by making use of the information registered by the User on Connect Job Workers screen (hereinafter referred to as ”Registration Information”, not limited to CVs) and the User's history of use of the Service (including, but not limited to, page view, application history, reply to applications from the User, etc., and e-mail sent and received from the User and the Recruiting Companies, Offer reception, Offer opening, Offer reply, and status of job change activities through the Service; hereinafter referred to as ”Use History”).

Article 2 (User)

  1. After User Registration and approval by FVC, the User shall be able to use the Service.
  2. Upon User Registration at Connect Job Workers or use of the Service, the User shall be deemed to have accepted all of the terms and conditions of this Connect Job Workers Terms and Conditions and the privacy policy of FVC (hereinafter collectively referred to as the ”User T&C”). Manifestation of intention to disapprove shall be permitted only by not registering as a User in Connect Job Workers.

Article 3 (Registration and Responsibilities of User)

  1. The User of this Service shall be the registered User of Connect Job Workers when he/she registers with Connect Job Workers on his/her own will and responsibilities. The User shall use the Service according to the method that FVC notifies the User.
  2. The User himself/herself shall be responsible for the accuracy, authenticity, and newness of the content of any and all Registered Information registered in Connect Job Workers by the User.
  3. Users can change, add, or remove Registered Information, etc. registered in Connect Job Workers at any time by themselves or through FVC on Connect Job Workers user-only page. Provided, however, that if Connect ID (meaning the ID to be granted by FVC in accordance with the procedures separately stipulated by FVC when using the various services provided by FVC; the same shall apply hereinafter) is used for but deleted from Connect Job Workers login ID (including the case where the User deletes the ID by himself or herself, but irrespective of the reason), the User Registration of Connect Job Workers is also cancelled at the same time. All information related to the login ID owned by FVC, such as the application history, the job application history, or messages by Recruiting Companies and other registration information registered by the User in Connect Job Workers, becomes no more available.
  4. The User agrees in advance that a Connect ID is required to use Connect Job Workers. In the event that FVC cannot confirm that the relevant inquirer is identified to be the User when the User makes an inquiry to FVC, FVC cannot respond to the inquiry from the relevant User. The User of Connect Job Workers shall register with the User Registration after acknowledging in advance the above.
  5. In the event the User receives a claim or request for deletion of Registration Information from a third party due to an error in all or part of the Registration Information, etc. registered on Connect Job Workers, the User shall approve in advance that FVC shall delete all or part of the Registration Information, etc. without prior notice.
  6. Even if the User does not cancel the User Registration or does not wish to cancel the User Registration, in the event the User does not log in to Connect Job Workers user-only page at any one time within one year after the User Registration, then the User Registration may be cancelled or terminated during Connect Job Workers database maintenance.
  7. Even if the User does not desire to stop the delivery of emails from Connect Job Workers, if FVC delivers emails to the User but Connect Job Workers email server receives an error notification such as an incoming mail server error or unknown address more than a certain number of times, then the User’s email address may be deleted from the mail delivery destination during the maintenance period of Connect Job Workers database.
  8. Transmitted and received messages (including the content of Offers sent and received) from Recruiting Companies stored by Users in Connect Job Workers database that exceed one year's worth may be deleted during maintenance of Connect Job Workers database.
  9. In the event the FVC is unable to confirm whether or not the User has the intention to continue using the Scout for a certain period of time or longer, the User shall approve in advance that he/she may be excluded from the subject of Scout without prior notice.
  10. The User shall use the Service after acknowledging in advance that FVC does not guarantee (a) the certainty of the recruitment, (b) the availability of Offers or job information from Recruiting Companies, (c) the acceptance of recommendations from Recruiting Companies which is the provider of the job information, (d) being hired by or the employment at Recruiting Companies, or (e) any and all of other effects of the Service.
  11. Upon commencement of use of the Service, the User shall acknowledge in advance that it may receive Information Service on Individual FVC Services. However, the User shall confirm that, regardless of provision of such information on Individual Services, each Individual Service will not commence to the User upon receipt of said guidance. If there are procedures separately stipulated by FVC, such procedures shall be followed and the Individual Services shall be used thereafter.
  12. The User shall not perform Items a. to h. below in Connect Job Workers.
    1. Intentionally registering/providing false information;
    2. Registering/providing information that is not relevant to the applicant;
    3. Acts that infringe upon the rights of others, such as copyrights, trademark rights, privacy rights, name rights, portrait rights, honor, etc.;
    4. Act of slandering individuals or groups;
    5. Acts that are or are likely to be contrary to laws and regulations, public order and morality;
    6. Registration/provision of information for the purpose of profit;
    7. Acts that are detrimental to FVC or a third party; and
    8. Acts that interfere with the operation of Connect Job Workers or that impair the confidence or reputation of FVC.

Article 4 (Personal Information)

FVC shall handle personal information of Users in accordance with the Privacy Policy separately provided.


Article 5 (Use of Personal Information)

  1. FVC shall be entitled to use the personal information of the User within the scope necessary for the operation of the Service during the provision of the Service to the User and after the termination of the Service (including, but not limited to, confirming the progress of the selection, the fact of adoption, the conditions of employment, and the fact of employment or retirement to the Recruiting Companies).
  2. FVC shall be entitled to use the personal information of the User in Connect Job Workers and Individual Services that the User wishes to use or uses (including, but not limited to, the distribution of advertisements to those who may possibly become Users), and the User shall approve such use in advance. FVC shall be entitled to provide personal information of Users to Recruiting Companies for the purpose of encouraging job-seekers to change jobs.

Article 6 (Information to be Provided by the Service)

  1. Users shall acknowledge that FVC makes no warranty as to the newness, authenticity, legality, safety, appropriateness, usefulness and recruitment certainty of the information provided at Scout (including, but not limited to, corporate information on the Recruiting Company, information provided by third parties including FVC Agents and Agents as well as information provided by third parties such as Agents including, but not limited to, job information and advertising), information provided by the User in the first interview useful report, and information provided by Recruiting Companies which is made at the responsibility of third parties including the Recruiting Company or Agent. Users shall use such information at its own responsibility.
  2. FVC shall not in any way warrant that:
    A. there will be no failure, error or defect in the provision of the Scout;
    B. Information obtained from Scout is accurate; or
    C. Scout and goods, services, and information available through Scout shall meet the expectations of the User.
  3. Even if any third party reprints information provided on Connect Job Workers on any website other than Connect Job Workers, FVC makes no warranty as to the update, truth, legality, security, appropriateness, or usefulness of the information on such website, whether or not the reprint is identifiable to the User as a reprint from Connect Job Workers.

Article 7 (Force Majeure)

FVC shall not be liable for any damage caused by virus damage, acts of God, or other causes not attributable to FVC (hereinafter referred to as ”Force Majeure”) that cannot be prevented by viral measures normally taken. FVC cannot guarantee that these Force Majeure will not erase or alter data in the Service. The User is requested to store the data in this Service at his/her own responsibility.


Article 8 (Questionnaire to Users)

  1. The User will, with his/her own will and responsibility, provide opinions and information to the questionnaires, etc., (hereinafter referred to as ”Questionnaires”) that FVC conducts to the User.
  2. FVC may edit and reprint the contents of the Questionnaire results on any media edited and published by FVC without the prior consent of the User. In this case, all copyrights in the reprinted Questionnaire results shall belong to FVC.
  3. FVC shall be entitled to send a Questionnaire to the User based on the CVs, and to conduct a hearing or interview by sending a telephone call or e-mail, for the purpose of the quality improvement of Scout, support for User’s job seeking activities, and confirmation to the User of the acquisition or comprehension of effect of Scout (including but not limited to confirmation of the use and progress of FVC Agents and Agents by the User, the contents of services provided by FVC Agents and Agents, and the status of selection by Recruiting Companies, etc.) (hereinafter collectively referred to as ”Effect Capture”).
  4. FVC may use the information obtained from the User in accordance with the preceding clause for the purpose of improving the quality of Scout, supporting the job-changing activities of the relevant User, Effect Capture, and inquiring about the facts to the Recruiting Companies.

Article 9 (Inspection, Compilation and Use of Statistical Information, Attribute Information, and Use History)

  1. FVC may prepare statistical data, etc., which are processed based on the personal information of the User so that it cannot identify a specific individual. FVC may without any restriction use such statistical data that cannot be personally identified.
  2. Users shall acknowledge in advance that FVC may browse the Use History of the Services and the opening status of the Offer sent to the User by the Recruiting Companies that sent the Offer using the system of the Services. In addition, as set forth in each of the following items, FVC may view and use the history of sending and receiving messages sent and received between the User and the Recruiting Companies (including, but not limited to, messages from the Recruiting Companies to the User, applications from the User, opening of messages from the User by the Recruiting Companies, reply to applications from the Recruiting Companies and the status of sending and receiving e-mails, etc.), and the contents thereof, and the User shall approve the foregoing.
    1. FVC may view and use to the extent necessary for other operations to provide information on the Recruiting Companies which made an Offer to Users, in order to ascertain the status of operation of the Services;
    2. The period of access and use stipulated in the preceding item may continue after the User ceases to be a User (irrespective of the reason); and
    3. Statistical data may be produced after aggregation, analysis and processing to prevent identification of a specific individual, and may be used by FVC without restriction (including, without limitation, proposals to Recruiting Companies and third parties, market research, and development of new services) with respect to such statistical data, etc.

Article 10 (Elimination of Antisocial Forces)

  1. Users shall declare that they do not and will not in the future fall under the category of organized crime groups, members of organized crime groups, persons who have not yet passed five years from the time they ceased to be members of organized crime groups, members of organized crime group quasi-members, corporations related to organized crime groups, corporate racketeers, etc., societal movement fraudsters, special intellectual violence groups, etc., or other persons equivalent thereto (hereinafter referred to as ”Antisocial Force(s)”) and that they do not and will not in the future fall under any of the following categories:
    1. Having a relationship whereby the management is found to be controlled by an Antisocial Force;
    2. The juridical person has a relationship in which an Antisocial Forces is found to be substantially involved in the management of such juridical person;
    3. Having a relationship that is found to be unjustly utilizing Antisocial Forces such as for the purpose of seeking illicit gain for oneself or a third party or for the purpose of inflicting damage on a third party;
    4. Having a relationship that is found to be providing funds or benefits to Antisocial Forces; or
    5. An officer or a person who is substantially involved in management has a relationship with an Antisocial Force that should be socially criticized.
  2. The User shall promise not to engage in any of the following acts by himself/herself or by using a third party:
    1. Violent demands;
    2. Unreasonable demands beyond legal responsibility;
    3. c. Conduct that involves intimidating behavior or use violence in connection with transactions;
    4. The act of spreading rumors, damaging the credibility of the other party by using fraudulent means or by force, or obstructing the business of the other party; or
    5. Other acts equivalent to the above.

Article 11 (Expulsion)

In the event that FVC determines that a User has violated the User T&C, FVC may suspend the use of all or part of the Services of said User or expel said User from Connect Job Workers User without prior notice to said User. In addition, depending on the form of violation of the User T&C, FVC may, at its discretion, invalidate any application or inquiry from the User to the Recruiting Companies without prior notice to the User, and if the User has been set to receive Scout, invalidate such Scout in the future, invalidate any message from the Recruiting Companies, reply from the User to the Recruiting Companies, or invalidate any inquiry to FVC, and take other measures that FVC deems appropriate.


Article 12 (FVC Liability)

FVC shall not be liable for any damages (including mental distress, interruption of job seeking activities, or any other disadvantage such as financial loss) arising from User Registration in the Services and the use of the Services by the Users (including, but not limited to, the act of providing information by FVC, the Recruiting Companies, or by a third party in connection therewith) unless FVC is negligent. In addition, even if FVC is liable, FVC's liability shall be limited to direct and ordinary damages except for FVC’ willful misconduct or grossly negligence.


Article 13 (Change of Service)

  1. FVC may change or temporarily suspend the Service without prior notice to the User.
  2. FVC may suspend or terminate the provision of the entire Service on a one-month notice period to the User.

Article 14 (Temporary Discontinuation of the Service)

  1. FVC may temporarily suspend the Service without prior notice or approval in the event of any of the following:
    1. System maintenance or modification;
    2. In the event that a natural disaster or other emergency occurs or threatens to occur and the operation of the Service is difficult; or
    3. In the event FVC determines that it is unavoidable.
  2. The contents, information and URL of this Service are subject to change or abolishment without notice.

Article 15 (Change of User Regulations)

FVC may change the User T&C from time to time. The details of the change shall be deemed to have been approved by the User when they are displayed on Connect Job Workers for one month.


Article 16 (Governing Law and Jurisdiction)

The Service and the User T&C shall be governed by the laws of Japan. Any and all disputes arising in connection with the Service or the User T&C shall be settled in the Tokyo District Court or the Tokyo Summary Court as the exclusive jurisdictional court of the first instance.
